Welcome to Divine Rummy owned and operated by SOFTLYVE TECHNOLOGIES PRIVATE LIMITED (“Divine Rummy”, “We”, “Us”). By accessing or using https://divinegames.in (“Platform”), you agree to be bound by these terms. We reserve the right to modify these terms at any time. Continued use constitutes acceptance of revisions.

1. LEGALITY & ELIGIBILITY

1.1 Geographic Restrictions

  • This Platform is accessible only in Indian states/UTs where online skill-based Rummy is legally permitted
  • You confirm you are not accessing from Assam, Odisha, Telangana, Andhra Pradesh, Nagaland, Sikkim, or other prohibited jurisdictions

1.2 Age Requirement

  • You must be at least 18 years old (21+ if residing in Tamil Nadu)
  • Must be competent to contract under the Indian Contract Act, 1872
  • We reserve the right to terminate accounts of underage users or those violating jurisdictional laws

2. ACCOUNT & MEMBERSHIP

2.1 Registration

  • To play cash games, you must register with valid ID proof (Aadhaar/PAN), address, and bank details
  • Guest play is restricted to free games
  • You warrant all information is true, accurate, and current

2.2 Account Security

  • You are solely responsible for account security
  • Report unauthorized access immediately
  • We may suspend accounts suspected of fraud, collusion, or multiple registrations

3. GAME RULES & FAIR PLAY

3.1 Skill-Based Game

  • Rummy is recognized as a game of skill under Indian law
  • Outcomes depend on player expertise, not chance

3.2 Prohibited Conduct

You agree NOT to:

  • Use bots, scripts, or third-party tools to manipulate gameplay
  • Engage in chip dumping, collusion, or money laundering
  • Post abusive/defamatory content in chat rooms

3.3 Game Integrity

  • We use certified RNG (Random Number Generator) to ensure fairness
  • All games are recorded for dispute resolution

4. FINANCIAL TERMS

4.1 Deposits & Withdrawals

  • Deposits must be from self-owned payment instruments (UPI/Bank Transfer/Wallets)
  • Withdrawals are subject to KYC verification and anti-fraud checks
  • Minimum withdrawal: ₹100

4.2 Contest Fees & Winnings

  • Entry fees for cash games are final and non-refundable
  • Winnings are taxable under Income Tax Act, 1961
  • TDS @31.2% applies on net winnings exceeding ₹10,000 per financial year

4.3 Refund Policy

  • Refunds are processed only for technical errors attributable to the Platform

5. INTELLECTUAL PROPERTY

5.1 Ownership

  • All game designs, software, and content are owned by Divine Rummy
  • You receive a limited, non-transferable license to access the Platform

5.2 User-Generated Content

  • Chat messages, profile data, and feedback (“User Content”) become our property
  • We may moderate/remove content violating community guidelines

6. LIMITATION OF LIABILITY

6.1 Disclaimers

We are not liable for:

  • Losses due to internet disruptions or device failures
  • Errors in third-party payment gateways
  • Tax liabilities arising from your winnings

6.2 Indemnification

  • You agree to indemnify us against claims arising from your breach of these terms

7. TERMINATION

  • We may terminate your account without notice for violations of terms, suspicious activity, or legal requirements

8. ELECTRONIC COMMUNICATIONS

  • When you use the platform or send emails or other data, information or communicate to us, you agree and understand that you are communicating with us electronically
  • You give your consent to receive communications electronically from us periodically, when required

9. USER ACCOUNT CREATION AND OPERATION

9.1 Registration Process

  • To use our Services, you will need to register with us on the Website/app
  • By completing the online registration process, you confirm your acceptance of the Terms
  • You agree to receive promotional messages relating to Tournaments & Bonus through SMS, Email and Push Notifications
  • You may withdraw your consent by sending an email to [email protected]

9.2 Account Information

  • You must provide correct details in all fields requiring your personal information
  • We may require additional documentary proof for verification
  • You are responsible for protecting your account information

10. USER RESTRICTIONS

10.1 Anti-Cheating and Anti-Collusion

  • You must play all Games yourself without external assistance
  • No use of bots, scripts, or third-party tools
  • No team formation or collusion

10.2 Money Laundering

  • No activities that may be construed as money laundering
  • No deliberate losing of money to certain players

10.3 Multiple IDs

  • Registration is restricted to a single user account
  • No creation or use of multiple user IDs

11. TRANSACTIONS & PAYMENTS

11.1 General Terms

  • All transactions shall be in Indian Rupees
  • Payments must be made through your Divine Rummy user account
  • All cash prizes are credited to your user account

11.2 Payment Processing

  • Credit card, Debit card, prepaid cash cards and internet banking payments are processed through third-party payment gateways
  • We are not responsible for delays or denials at their end
  • We have the right to cancel transactions at our discretion

12. WITHDRAWALS

12.1 Withdrawal Process

  • Withdrawals are made via electronic bank to bank transfer
  • KYC documents may be required for verification
  • Withdrawals are subject to bonus/prize money restrictions

12.2 Withdrawal Conditions

  • No processing charges as per prevalent policy
  • Delays may occur due to verification process
  • No compensation for delays in processing

13. SERVICE CONNECTIVITY

  • We are not liable for internet connectivity issues
  • No responsibility for local internet environment issues
  • No liability for software or hardware setup issues

14. ACCOUNT SUSPENSION AND TERMINATION

14.1 Suspension Rights

  • We reserve the right to suspend or terminate accounts for terms violation
  • Our decision is binding and at our sole discretion

14.2 Voluntary Termination

  • Withdrawable cash balance will be transferred after verification

15. BREACH AND CONSEQUENCES

We may take the following actions:

  • Stop services indefinitely
  • Permanently terminate account
  • Collapse withdrawable cash
  • Demand compensation for damages
  • Bar future registration

16. COMPLAINTS AND DISPUTES

17. CONTENT & PROMOTIONS

  • All content is protected by intellectual property laws

18. GAME RULES

  • We reserve the right to determine results and winners

19. DISCLAIMER & INDEMNITY

  • Maximum liability limited to Rs. 2,000/-
  • No liability for financial losses
  • Users must indemnify the Company against claims

20. INACTIVE ACCOUNTS

  • Account considered inactive after 12 months of no login
  • Monthly maintenance charge: Rs. 250/-
  • Account closure after 15 days of negative balance

21. MOBILE NUMBER VERIFICATION

  • Required for playing Cash games
  • Mandatory for all cash users
  • Information kept confidential

22. ADD CASH LIMITS

  • Maximum limit: Rs 50,000 per transaction

23. GOVERNING LAW

  • Terms interpreted according to Indian law
  • Exclusive jurisdiction: Civil courts at Bangalore
